Application and amendment

Access and use of this web site is subject to these terms. By accessing or using this website, you agree to be bound by these terms.

Indulgence Flyfishing may amend these terms without notice and you should regularly check these terms so that you are aware of any amendments. Use of this website after any amendments constitutes your acceptance of the terms as amended.
Intellectual property

Indulgence Flyfishing owns or licenses the copyright in and trade marks on the Indulgence Flyfishing web site and all of the website’s content (other than product images and descriptions). Indulgence Flyfishing reserves its rights in that intellectual property. Apart from uses permitted by the Copyright Act 1968 or this licence, no part of that intellectual property may be reproduced or provided to the public, in any form or by any means, without Indulgence Flyfishing’s written consent.

Indulgence Flyfishing grants you a limited licence in relation to the content of the Indulgence Flyfishing web site. This includes the text, registration facilities, hyperlinks, and the underlying HTML, XML and any other coding. You may display it on your computer, print it and download it.

Alteration

Indulgence Flyfishing may remove and edit any material posted to the Indulgence Flyfishing website.

Indulgence Flyfishing does not moderate forums which are provided for general communication and discussion between users of the Indulgence Flyfishing website, but may remove material from the forums.

Views or recommendations appearing in the forums do not necessarily reflect the views of Indulgence Flyfishing and the inclusion of such views or recommendations in the forums does not necessarily indicate any endorsement of those views or recommendations.

To the extent permitted by law, Indulgence Flyfishing is not liable to you for any liability arising in relation to your use of this website and the material on this website (including in the case of negligence) and excludes any implied terms.
Governing law

These terms are governed by and must be construed in accordance with the laws of Victoria. Each party irrevocably and unconditionally submits to the non-exclusive jurisdiction of the courts of Victoria and all courts which have jurisdiction to hear appeals from those courts.

Privacy Policy

To enable us to operate our business and the Indulgence Flyfishing website, we need to collect personal information such as your name and address. We use this information to provide our products to you.
We may also use this information to send you details of other products and services that may be of interest to you. If at any stage you no longer wish to receive this additional marketing material, please let us know and we will remove your details from our marketing database.

If you choose not to provide your personal information, we may not be able to provide our products to you.
In relation to collection of personal information via our website, we use two types of cookies, namely:

Unless we are required to provide your personal information to others by law, by court order or to investigate suspected fraud or other unlawful activity, your information will only be seen or used by persons working for Indulgence Flyfishing.
You can also help us protect your personal information by taking precautions when using the Internet. It is a good idea to regularly change any passwords and to use a secure browser.
We do not and will not share your private information with any third parties unless required to do so by law. You can shop with confidence with Indulgence Flyfishing for you fly fishing supplies.

Refunds and returns

You must choose your products carefully. Indulgence Flyfishing is not under any obligation to refund or exchange products if you change your mind or choose the wrong product (including in the case of incompatibility).

Unused and unopened items may be returned to Indulgence Flyfishing for a refund or store credit at our discretion within 7 days of receipt of goods however our original shipping costs to you may be deducted from the sale amount. If we choose to accept opened/used goods, a restocking fee will be charged.

Indulgence Flyfishing will refund or exchange products:

– which do not correspond with their description;

– not of merchantable quality; or

– not fit for their disclosed purpose,

which are returned in the condition in which they were supplied with the receipt within 7 days after receipt of goods.

The customer is responsible for costs associated with shipping goods back to us.

If returning goods, please pack items carefully as Indulgence Flyfishing is not liable for any goods damaged in transit. Please consider using a shipping method with tracking and insurance as Indulgence Flyfishing is not liable for goods lost in transit.

If you wish to cancel a transaction prior to your order being dispatched, please contact us via our “Contact Us” page or by sending an email to sales@indulgenceflyfishing.com.au

Indulgence Flyfishing may cancel an order or part of an order where products become unavailable, by notice to you, and will refund the purchase price paid by you.

COVID related cancellations and conditions

Indulgence Flyfishing will notbe following the latest mandate release and treating Covid sickness with a wave off. I respect my clients as to not infect them and I expect the same respect back towards myself and my business.

If anyone is booked in with me and shows any sign of Covid Systems I will require immediate notification so that we can postpone the trip to another date.
If anyone turns up on the day and shows systems or says that they are recovering; A Rapid Antigen Test will be required to prove a negative reading for the day to commence and if a Positive reading is given on the day; It will be forfeit and NO REFUND or alternative date be sorted.

I can not afford to throw my time and money away on anyone who will not respect myself or others.

I am a pretty fair and understanding Guy and I know things can go haywire at times.
If you are fair to me; I will be more than fair to you.

Third party warranties

Any product warranties are provided by the supplier or manufacturer of the product. Any claims under such warranties should be directly to the supplier or manufacturer in question.
We at Indulgence Flyfishing stand behind the products we sell, please contact us immediately if you have an issue with your item. We would prefer to resolve the issue quickly so you can continue fishing.

Liability

Indulgence Flyfishing’s liability arising out of the agreement is limited to the amount paid for the product in question; and in no event will Indulgence Flyfishing be liable to you (whether in contract, tort (including negligence) or otherwise) for any consequential, special, incidental or indirect loss or damage including loss of profit (whether consequential, special, incidental or indirect) that may arise under the agreement.

Nothing in the Agreement excludes, restricts or modifies any term of the Trade Practices Act 1974 where to do so would result in a term of the agreement being illegal or void.

Indulgence Flyfishing simply wants you to enjoy your products and for you to let your fish go to be caught another day. Please practice responsible catch and release techniques.
